CITY OF LAKE LILLIAN

COUNTY OF KANDIYOHI

STATE OF MINNESOTA

AN ORDINANCE ENACTING THE CODE OF ORDINANCE FOR THE

CITY OF LAKE LILLIAN, MINNESOTA,

ADOPTING THE MINNESOTA BASIC CODE AND AMENDING, RESTATING,

REVISING, UPDATING, CODIFYING, AND COMPILING CERTAIN ORDINANCES

OF THE CITY DEALING WITH THE SUBJECTS EMBRACED IN THE CODE OF

ORDINANCES, AND PROVIDING PENALTIES FOR THE VIOLATION OF THE

CODE OF ORDINANCES.

WHEREAS Minnesota Statutes Section 471.62 authorizes the city to adopt the Minnesota Basic

Code by reference, and Sections 415.02 and 415.021 authorize the city to cause its ordinances to

be codified and printed in a book,

NOW THEREFORE the City Council of the City of Lake Lillian, Minnesota, ordains:

Section 1. The Minnesota Basic Code, First Edition, together with amendments and supplements

contained therein, is hereby adopted and shall constitute the “Code of Ordinances of the City of

Lake Lillian.” This Code of Ordinances also adopts by reference certain statutes and

administrative rules of the State of Minnesota as named in the Code of Ordinances.

Section 2. The Code of Ordinances as adopted in Section 1 shall consist of the following titles:

TITLE XIII: GENERAL OFFENSES

130. General Offenses

Section 3. All prior ordinances, except zoning and subdivision ordinances, shall be deemed

repealed from and after the effective date of this ordinance, except as they are included and re-ordained

in whole or in part in the Code of Ordinances; provided, this repeal shall not affect any

offense committed or penalty incurred or any right established prior to the effective date of this

ordinance, nor shall this repeal affect the provisions of ordinances levying taxes, appropriating

money, annexing or detaching territory, zoning or subdividing land, establishing franchises,

granting special rights to certain persons, authorizing public improvements, authorizing the

issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal

property, granting or accepting easements, plat or dedication of land to public use, vacating or

setting the boundaries of streets or other public places; nor shall this repeal affect any other

ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by

the Code of Ordinances. All fees and charges established in ordinances or resolutions adopted

prior to the adoption of this city code shall remain in effect unless amended in this code or until an

ordinance adopting a schedule of fees and charges is adopted or amended.

Section 4. This ordinance adopting the Code of Ordinances shall be a sufficient publication of any

ordinance included in it and not previously published in the city’s official newspaper. The Clerk

of the city shall cause a substantial quantity of the Code of Ordinances to be printed for general

distribution to the public at actual cost and shall furnish a copy of the Code of Ordinances to the

County Law Library or its designated depository. The official copy of this Code of Ordinances

shall be marked and kept in the office of the City Clerk.

Section 5. The Code of Ordinances is declared to be prima facie evidence of the law of the city

and shall be received in evidence as provided by Minnesota Statutes by the Courts of the State of

Minnesota. A copy of the Code of Ordinances marked “Official Copy” shall be filed as part of the

official records of the city in the office of the City Clerk. The City Clerk shall provide a copy of

the Code of Ordinances to any person who requests a copy and shall charge that person the cost to

the city of the copy of the Code of Ordinances.

Section 6. This ordinance adopting the Code of Ordinances, and the Code of Ordinances itself,

shall take effect upon publication of this ordinance in the city’s official newspaper.

AN ORDINANCE AMENDING ORDINANCE NO. 2006-2

SCHEDULE OF FEES AND CHARGES FOR VARIOUS

SERVICES, LICENSES AND PERMITS FOR THE

CITY OF LAKE LILLIAN, MINNESOTA

 

 

The City Council of Lake Lillian, Minnesota ordains:

 

Section 2 of Ordinance NO. 2006-2 An Ordinance Adopting a Schedule of Fees and Charges for Various Services, Licenses and Permits for the City of Lake Lillian, Minnesota is amended to read as follows, effective February 1, 2011:

 

Section 2.  The following are the fees and charges for the permits, licenses and services listed below which are referenced to the section of the city code which authorizes their establishment:

 

  1. The sewer service rates and charges to users shall be rendered monthly as follows:  a monthly base rate of $12.50; residential and business users shall be charged for sewer service based on water use, $4.83 for each 1,000 gallons.  If a user disconnects during a billing period, the amount due will be determined by a final meter reading.  Sewer rates and charges may be changed by amendment to this ordinance from time to time pursuant to city code section 51.113(D) and 51.114.

 

  1. The connection fee for sewer service pursuant to city code section 51.116(D) shall be $500.00.

 

  1. The fee for each 1,000 gallons of water used from a fire hydrant pursuant to city code section 52.08(A)(4) shall be $11.50.

 

  1. The fee to be collected before service is recommenced pursuant to city code 52.33(B)(4) or an owner requested shut-off shall be $100.00.

 

  1. The connection fee for water service pursuant to city code 52.72(B)(4) shall be $500.00.

 

  1. The rate due and payable from each user for water taken from the water system pursuant to city code 52.53(A) shall be rendered monthly as follows:  a monthly base rate of $26.50 and $7.15 for each 1,000 gallons of water used; in addition, $7.50 will be collected monthly to be placed in a Water Tower Reserve for future water tower needs.  If a user disconnects during a billing period, the amount due will be determined by a final meter reading.  Water rates and charges may be changed by amendment to this ordinance from time to time pursuant to city code section 52.51 and 52.53.

 

  1. The fee for dog and cat licenses pursuant to city code 91.02(B)(1) and (2) shall be $7.50.

 

  1. The fee for a liquor license pursuant to city code 112.23(C) shall be $125.00 annually for each an on-sale Wine and on-sale 3.2 percent malt liquor license; $20.00 annually for an off-sale 3.2 percent malt liquor license; $250.00 annually for On-Sale Intoxicating license; $100.00 annually for Sunday Sales license; and $100.00 annually for an off-sale intoxicating liquor license.  The fee for a Set Ups license shall be $35.00 annually; the fee for a Live Dance/Entertainment license shall be $25.00 annually; the fee for an Operation of Games of Skill license shall be $5.00 per game annually.

 

  1. The fees for Fire Calls pursuant to city code 31.00 (A) shall be $300.00 for the first hour of equipment and man-hours; each additional hour $150.00 for equipment and $9.00 per man-hour; maximum charge per call $1,000; standby $100.00; additional standby $50.00 per hour; false alarms $100.00 and motor vehicle accidents $100.00 per vehicle.

 

  1. The fee for rental of the City Center community center pursuant to city code 30.11 shall be $50.00 for the front room only, $30.00 for the back room only and $80.00 for the entire building per day or event.  The fee for rental of the Meeting Room shall be $25.00 per day or event

 

  1. The fee for rental of the following city property pursuant to city code 30.11 shall be: tables and/or   

picnic tables $3.00 each per day or event, chairs $2.00 per ten (10) per day or event, Fire Dept grills $25.00 per grill per event. 

 

  1. The fee for Land Use Permits pursuant to city zoning code 11.10 shall be:  land use permits $10.00;

      Conditional Use permits $50.00; Variance permits $50.00.
